FinSim is an educational market simulator. All trading is simulated (“paper”) with simulated money — no real orders are placed and no real money is involved. FinSim is not financial advice, not a recommendation, and not a signal service. Obsidian Metrics is not a registered investment adviser or a broker-dealer.

0. How to read these Terms

These Terms of Service (“Terms”) are the agreement between you and Andrew Lang, doing business as Obsidian Metrics, a sole proprietorship based in Pennsylvania, USA (“Obsidian Metrics,” “we,” “us”), governing your use of FinSim, also presented in-product as “Obsidian Market Replay” (the “Service”). Plain-English summaries appear in italics; the numbered text is the actual agreement. By signing in to FinSim, clicking “I agree,” or paying for a tier that includes FinSim, you accept these Terms and the master Obsidian Metrics Terms of Service, which are incorporated by reference. If there is a conflict about FinSim, these Terms control for FinSim.

1. What FinSim is — and what it is not

In plain English: FinSim is a market simulator. You practice with fake money against real historical market data to learn. Nothing in it is real trading, real money, or advice.

1.1 FinSim is an educational simulation. It lets you practice trading decisions using simulated (“paper”) money against real historical or delayed market data, replayed in daily bars. It exists to teach how markets, orders, and strategies behave.

1.2 FinSim is NOT:

1.3 We are not your adviser or fiduciary. Obsidian Metrics is not a registered investment adviser, broker-dealer, commodity trading advisor, or financial planner. Using FinSim — including any AI feature — creates no advisory, fiduciary, or client relationship.

1.4 All money, positions, profits, and losses in FinSim are simulated. They exist only inside the simulation and have no real-world value, and cannot be withdrawn, transferred, or converted.

2. Educational purpose; your decisions are your own

2.1 Everything in FinSim is for education and general information only. We do not provide personalized financial, investment, tax, legal, or accounting advice.

2.2 Any real financial decision you make is entirely your own. Nothing you see in FinSim — a simulated profit, an AI agent’s trades, a leaderboard — should be relied on for real trading. Consider consulting a licensed professional before making real financial decisions.

2.3 No performance promises. We make no claim, promise, projection, or implication that any strategy, AI feature, or simulated result would produce any return, profit, or outcome in real markets. Simulated or past performance, real or simulated, does not indicate future results.

3. AI and competition features

In plain English: you can watch two demo bots compete inside the simulation. It is a demonstration, not money management and not advice.

3.1 The competition tracker (for example, Claude vs local AI) shows two demonstration bots trading a simulated ledger for education. It is not a track record, not a performance advertisement, and not a signal feed, and its output must never be used as one — by us or by you.

3.2 If we offer AI-directed simulation inside your own sandbox on a paid tier in the future, it will run only if you enable it, and you will be able to disable it at any time through an in-product control. Any such AI activity is simulated demonstration only — not money management, not a robo-adviser, and not a recommendation about any real security.

3.3 AI output can be wrong, arbitrary, or unlike anything a prudent person would do. That is part of what the demonstration teaches.

4. Accounts, eligibility, and access

4.1 FinSim access requires an Obsidian Metrics community account. Identity, passwords, and email verification are handled by our authentication provider; FinSim itself never stores your password.

4.2 You must be at least 18 years old (or the age of majority where you live, if higher).

4.3 Your access tier (free preview, Premium, VIP) is determined by your community membership. We may change what each tier includes; material reductions to a paid tier take effect no earlier than your next renewal.

4.4 One account per person. Do not share paid access or attempt to circumvent tier gating.

5. Simulation data, accuracy, and limits

5.1 FinSim uses real historical and/or delayed market data, which may contain errors, delays, or gaps. Replay is daily-bar, not intraday; future bars are never shown before the simulation reaches them.

5.2 Options and certain instruments are modeled (for example, Black-Scholes marks), not historical quotes, and are simplifications.

5.3 Simulated fills and mechanics are approximations. Real markets involve costs, slippage, liquidity limits, taxes, and risks the simulation does not fully reproduce. A result achieved in FinSim would not necessarily be achievable in real markets.

5.4 We do not warrant the accuracy, completeness, or timeliness of any market data or simulated result.

5.5 We may reset, migrate, cap, or adjust sandboxes (for example, for data corrections or abuse). Simulated balances have no value and their loss is not compensable.

6. Your data and privacy

In plain English: FinSim stores very little about you. Your login lives with our auth provider; FinSim keeps only an anonymous ID and your simulated portfolio.

6.1 What FinSim itself stores: (a) a one-way, HMAC-derived anonymous user ID (we do not intentionally store your email address in FinSim’s application data); (b) your simulated sandbox — cash, positions, working orders, options book, and trade log — as a data blob keyed to that ID, with a last-updated timestamp; (c) a signed, httponly session cookie carrying your user ID, an encoded copy of your email, your tier, and an expiry (about 12 hours); and (d) a record that you accepted these Terms, with the version and a timestamp.

6.2 What third parties store: our authentication and database provider (Supabase) holds your community account identity (email, password hash, tier); if you pay, our payment processor and/or the community platform (Skool) hold billing data under their own terms. FinSim never sees or stores your card details.

6.3 Isolation. Your sandbox is isolated to your account and enforced server-side. Other members cannot see it. The competition tracker exposes only the two demonstration bots — never the owner’s private research environment and never any member’s sandbox.

6.4 Our Privacy Policy is part of these Terms.

6.5 On account termination or deletion request, we delete your sandbox data within a reasonable period, except records we must keep by law.

7. Subscriptions, billing, cancellation, refunds

7.1 FinSim’s free preview costs nothing. FinSim’s paid features are included in the Premium and VIP tiers. Billing, auto-renewal, cancellation, refunds, taxes, and any metered usage are governed by the master Obsidian Metrics Terms of Service. Cancelling drops you to the free preview at the end of the paid period; your sandbox is retained.

9.1 You may stop using FinSim and cancel at any time.

9.2 We may suspend or terminate your access if you breach these Terms, fail to pay, or use FinSim in a way that risks harm to us, other members, or the systems. Where practical and not urgent, we will give notice and a chance to fix the issue.

9.3 Sections that by their nature survive (disclaimers, liability limits, IP, governing law) survive termination.

10. Disclaimers of warranties

10.1 FinSim is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and uninterrupted or error-free operation.

10.2 We do not guarantee uptime, data accuracy, or that any simulation, AI run, or feature will work or complete in any timeframe.

11. Limitation of liability

11.1 To the fullest extent allowed by law, Obsidian Metrics and its owner will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or any financial loss arising from FinSim, from reliance on any simulated result or AI activity, or from any real trading or financial decision you make, whether or not influenced by anything you saw in FinSim.

11.2 To the fullest extent allowed by law, our total liability for any claim relating to FinSim is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 100.

11.3 Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to defend and hold Obsidian Metrics and its owner harmless from claims arising out of your misuse of FinSim, your violation of these Terms, or your presentation of FinSim output as advice or signals to any third party.

13. Changes to these Terms

We may update these Terms. For material changes we will give reasonable advance notice (email or in-product). Continued use after the change takes effect means acceptance; if you do not accept, cancel and stop using FinSim.

14. Governing law and disputes

14.1 These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-laws rules.

14.2 The state and federal courts located in Allegheny County, Pennsylvania have exclusive jurisdiction over any dispute relating to FinSim, and you consent to venue there.

14.3 If any provision is unenforceable, the rest stays in effect.
